  • Individuals within the state of Florida who are suffering from chronic and debilitating illnesses are eligible to receive medical cannabis. To start the process a patient must have an in-person visit with a Florida physician certified in compassionate use. A doctor must have an active, unrestricted medical license and must complete a course issued by the Florida Medical Association in order to provide certifications to patients.
  • Once the physician has examined the patient, the physician can qualify (or “certify”) them to be allowed to purchase medical marijuana. After a patient is certified by a physician they must complete an application for a medical marijuana ID with the Department of Health. When the Department approves the patient’s ID card application, the patient is then able to legally visit any of the state’s dispensaries or call a Medical Marijuana Treatment Center to arrange for delivery.
  • Patients are required by law to be re-certified every 210 days. The physician can certify up to a 70-day supply of cannabis at a time at a maximum daily dose that is yet to be determined by the Department of Health.

Step #1
Evaluation
First, you’ll be evaluated by a Florida marijuana doctor that is qualified to order medical marijuana. This includes an in person visit to the physician’s office. Once there you’ll be required to fill out a few standard forms that will become part of your medical record. Then the physician will complete a comprehensive medical evaluation to determine if medical marijuana may benefit you.
Step #2
recommendation
When the physician determines that your chronic condition meets the Department of Health requirements for Florida medical marijuana use, he or she will make a recommendation for medical marijuana use and establish a medical care plan on your behalf. This is similar to writing a prescription.
Step #3
registration
Once you have been recommended for medical marijuana use the physician must register your name and information with the Florida Department of Health’s Compassionate Use data base. This starts the process of getting an ID card from the Department of Health. Once you have the card, you will then be allowed to obtain your medical marijuana from a dispensary licensed by the Florida Department of Health. The entire process may take from 2-6 weeks depending on the specifics of each application.

Compassionate Medical Cannabis Act of 2014
The Compassionate Medical Cannabis Act was signed into law on June 16, 2014 (Chapter 381.986, Florida Statutes) allowing physicians licensed under Chapter 458 and 459 of the Florida Statutes to recommend the use of non-smoked low-THC (tetrahydrocannabinol) cannabis to patients who qualify. This law allowed limited medical marijuana use in the state of Florida; but did not fully legalize it. Florida’s Constitutional Amendment 2 of 2016
Amendment 2 was approved by an overwhelming 70% of the Florida voters on the November 2016 ballot. Medical marijuana use in the State of Florida was legalized with the passing of Amendment 2. The new law became effective January 3, 2017. It vastly expanded the list of chronic conditions approved for medical marijuana use in the state of Florida. Amendment 2 requires the Florida Department of Health to set regulations for the issuance of identification cards, qualifications and standards of care givers, and rules for the registration of medical marijuana treatment centers within six months of the effective date.
